Terms and Conditions Specific to Buyers

Prior to viewing/accessing sales details of any business available on our website, we require that you should carefully read, understand and accept the terms and conditions under which My Own Business are prepared to provide this information to you. Should you decide that you do not agree to be bound by the terms and conditions herein, you should neither register, nor attempt to access details, and certainly have no authority to directly contact any or all of our selling clients, in relation to any business that we display on our website.

IMPORTANT: By registering and/or accessing/downloading information, or utilising such information that is made available through this website, you agree irrevocably to be bound by the terms and conditions determined hereunder. Viewing/accessing sales particulars and/or the utilisation of information accessed by you, or any associated or related party to you, will constitute a legally binding agreement between you and My Own Business and you will be committed to accept and be bound by, the terms and conditions set out hereto.

Prior to any further action in this matter, you should seek appropriate legal guidance in relation to these terms and conditions, and consider any such action carefully.

By registering and/or viewing information on this website, as an individual, you hereby agree:

1. To treat with complete confidentiality, all information contained herein, and as and or may subsequently be supplied.
2. That you will not approach directly either the Owner of the business and/or Property relating to the business, either personally, by telephone or in writing, without the consent of My Own Business.
3. Only to visit the Owner and/or the Business/Property with a prior appointment made, and confirmed via the offices of My Own Business.
4. You will not approach any member of Staff of the business, nor discuss the proposed sale with any Staff member without the express consent of the owner(s).
5. Any request for any/all required information required including but not limited to business Trading Accounts, to be obtained solely through the offices of My Own Business.
6. Any offer for the purchase of the business and/or property to be made directly via the acting agents, My Own Business, and not to deal directly with the owner(s) of the business
7. In the event of agreement to purchase the Business and/or Property, you consent to pay My Own Business, a deposit amounting to 5% of the purchase price, but subject to a minimum of £5,000, as an act of good faith on your part. Said deposit will be held by My Own Business, in a current non-interest earning clients account with no interest being either due or paid. This deposit will be paid on a “Subject to Contract” basis, and will be fully refundable in the event of the purchase not proceeding to an exchange of contracts.
8. Upon an offer being accepted, ‘Subject to Contract’ on a Leasehold proposition; to supply to My Own Business, the names and addresses of appropriate and relevant referees, to include bankers, to whom My Own Business, can apply for a reference in order to seek the landlords consent for a lease.
9. Sales particulars and information will be prepared by My Own Business, purely as a guide, and whilst every precaution will be taken to ensure accuracy, My Own Business, will not accept any responsibility for any errors or inaccurate description by the Company or any of the company’s employees. Any intending purchaser must therefore satisfy themselves by inspection or other means, as to the accuracy and correctness of each of the statements contained within any particulars supplied. It is accepted that the sales particulars and information do not constitute any form of offer and are submitted entirely on a ‘subject to contract’ basis.
10. That, in the event of them breaching any of the aforementioned clauses or, in the event of them purchasing the business and/or property where the previous owner refuses to pay My Own Business, then the recipient agrees to be equally liable for the commission fees due and owing to My Own Business, at the point of purchase.
11. These terms and conditions are supplied in advance of any continuous negotiations taking place, and therefore any party progressing further does so in the full knowledge and acceptance that these terms are irrevocable and binding.
12. You hereby indemnify My Own Business, against any claims, costs, losses, expenses or damages the Company may incur howsoever arising, be that direct, indirect or consequential as a result of your use of this website.
13. That this agreement is subject to the ‘Consumer contracts Regulations 2013 - No.3134’ and the ‘Electronic Commerce (EC Directive) Regulations 2002’, and that the effective commencement of the service agreement shall be immediate, and upon registering on this site. By so doing, you are deemed to have accepted the terms and conditions as set out herein and My Own Business will immediately begin to provide you the services afforded by this website. Any and all future download of any business details and information will be accompanied by a further copy of these terms and conditions which can be printed or saved. This meets the ‘written confirmation’ requirements of the aforementioned acts.
